Case Strikes Down Medicaid Recovery Against Homestead in MS
On February 22, 2011 the Mississippi Court of Appeals rendered a decision that prevented the state Medicaid agency from recovering its nursing home expenditures from the estate of a deceased Medicaid beneficiary. In it opinion, the Court compared our law with that of other states and signaled how the law in Mississippi might be altered to permit such recovery in the future.
